The association, on behalf of itself and subsidiaries and worldwide affiliates and members, maintains this Website for informational, general promotional and public information. For more information about our members, please refer to our member list via Members. When using our Services we will collect and process your personal data in accordance with this Privacy Policy.

The Association may amend this Privacy Policy at any time by posting a revised version on this website, without providing prior notice to you unless a fundamental change to the nature of the use of your personal data is involved. Any such amendment will be effective at the time it is posted unless a delayed effective date is expressly stated in the revised version. Your continued use of this website after such changes have been posted will constitute your acceptance of the changes.

Depending on the services we provide, we may collect the following types of personal data from you:

  • Contact details – such as your name, company name or e-mail address, for example as part of registration, a survey or a request to receive information.

Purpose and grounds for processing of data

  • Execution of a contract – where there is a contractual obligation we may process your personal data in order to provide our Services whereby we make use of third parties (see ‘section 4: Use and distribution of personal data’ for further information). We may process your personal data for the purpose of contact verification, market research, and organization of promotions.
  • Based on your consent – we may process your personal data if you have explicitly consented to this, such as for marketing purposes or when you have signed up to receive updates or newsletters from us.
  • To meet a legal obligation – we may process your personal data where this is authorized by applicable legal provisions or necessary to comply with laws, regulations, court orders, investigations and similar legal instructions, to resolve disputes, and to protect the Associations or its members’ rights and property.
  • For our legitimate interests – such as the technical administration of our websites, for processing your requests, to transfer your data within the Association (and its members in their respective countries and their group affiliates) and for product-related surveys.

Distribution of personal data

In order to provide our Services we may share your personal data with third parties and employees on a strict “need-to-know” basis. These employees and third parties, like  agencies and dealers of the Association and its members, are obligated to maintain data confidentiality.

Your personal data may be shared with members of the Association. For more information about our members, please refer to our member list via Members. Furthermore, these members may be located in countries outside of the European Union. Your personal data may then be transferred outside of the European Union (see section 5: Transfer of your personal data).

Furthermore, your personal data may be distributed to third parties or other subcontractors  for the purposes as set out above. However, we will provide these contractual parties only with the personal data necessary to perform the work for which they were contracted.

Transfer of your personal data

Please note that by providing personal or proprietary information in any application or transaction request through this website, your personal data will be transferred to the United States for handling your application or transaction request (i.e. to a country outside of the EU). We ensure an adequate level of protection for your data by respective service providers joining the US Privacy Shield.

Your Rights

  • Right to information and the correction of data – At your request, the Association will without undue delay inform you in compliance with statutory regulations whether and which personal data on you has been stored. If, despite our efforts to ensure that the data is correct and up-to-date, we have stored incorrect data, we will of course correct it upon your request.   • Right to revoke your consent – You can revoke any consent you have given, at any time, and this revocation applies to all future use of your data. There will be an opt-out mechanism in the emails you receive, in addition, you may always notify us at the address specified below under “Contact Us”.
  • Data portability – to the extent that we use your personal data for the performance of the employment contract, and that personal data is processed by automatic means, you have the right to receive all such personal data which you have provided to us in a structured, commonly used and machine-readable format, and also to require us to transmit it to another data controller where this is technically feasible.
  • Right to restriction of data use – you have the right to restrict our use of your personal data where (i) you contest the accuracy of the Personal Data; (ii) the use is unlawful but you do not want us to erase the data; (iii) we no longer need the personal data for the relevant purposes, but you require them for the establishment, exercise or defense of legal claims; or (iv) you have objected to data use justified on our legitimate interests pending verification as to whether we have indeed compelling interests to continue the relevant data use.
  • Right to object – to the extent that we are relying on our legitimate interests to use your personal data, you have the right to object to such use, and we must stop such processing unless we can either demonstrate compelling legitimate grounds for the use that override your interests, rights and freedoms or where we need to process the data for the establishment, exercise or defense of legal claims

Data retention

The Association and its members will retain your personal information only for so long as it is helpful to support the overall purpose for which the information was collected and in accordance with applicable laws.

Most of the data will be stored in the United States of America. Please note that if you are a member of the Association, or a contractor, supplier, customer or other partner of the Association or any of its members, the use and protection of Personal Information may be subject to additional contractual obligations.

We endeavor to take all necessary technical and organizational security measures to ensure that your personal data is stored so that it is not accessible to third parties or the public. If you wish to contact us by e-mail, we point out that e-mail-communication cannot completely guarantee the confidentiality of the information you send.
